It also describes the choices available to you regarding the use of, your access to, and how to update and correct your personal information. Note that we combine the information we collect from you from the Site, through the Service generally, or offline.

Information Collection

ODeskWork.com is an online marketplace that connects clients & businesses with freelancers. When you visit ODeskWork.com you provide two types of informations: personal information-that you knowingly choose to disclose to ODeskWork.com and the information collected by ODeskWork.com as you interact with www.oDeskWork.com (the “site”).

When you register with ODeskWork.com as a Freelancer or as an Employer, you provide certain personal information, including, your name, your email address and your address. Additionally, when you establish your profile as a Freelancer or as an Employer you will provide information relating to your skills, experience, education level, compensation, work availability, geographic region and self-evaluation. Such information does not identify the specificity of the individual member. Employers are only shown basic information about freelancer and can communicate to them only using the ODeskWork.com Platform.

When you enter the website, ODeskWork.com collects your IP address and your location (If you allow). This information is gathered from all ODeskWork.com visitors. In addition, ODeskWork.com stores certain information from your browser using “cookies.” A cookie is a piece of data stored on the user’s computer tied to information about the user. ODeskWork.com uses session ID cookies to confirm that users are logged in. These cookies terminate once the user closes the browser. By default, ODeskWork.com uses a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you return to the Website. ODeskWork.com members must have cookies enabled on their browsers. Note, Cookie preferences are set within each browser’s Internet options/preferences.

If you post some information on a bulletin board, or participate in a public message board, you should be aware that any personally identifiable information you choose to provide there can be read, collected, or used by other users of these forums and could be used to send you unsolicited messages. ODeskWork.com will not responsible for the personally identifiable information you choose to submit in these forums.

ODeskWork.com is the sole owner of the information collected through the website.

Information Use

ODeskWork.com will not sell or rent any collected information to third parties. ODeskWork.com will not share your contact information with other users or third parties except in connection with possible employment and with your express consent. All registered ODeskWork.com members agree to the ODeskWork.com Privacy Policy and Terms of Service. Accordingly, all registered users agree that certain profile information is accessible to other registered users.

ODeskWork.com records IP addresses for system administration purposes. This information is used to diagnose server problems, monitor traffic patterns, analyze trends, administer the website, track member user patterns, and identify the most popular areas of the website to deliver content most relevant to registered members. IP addresses are not linked to personally identifiable information and are only used to gather broad demographic information for aggregate use, except in the case of fraud.

ODeskWork.com reserves the right to share aggregated demographic information with its partners and/or advertisers, such information will not be linked to personal information that identifies registered users, except in the case of fraud.

Links

The Website contains links to other websites and is not responsible for the privacy practices of such websites. ODeskWork.com encourages its members to read the privacy policies of all websites. This privacy statement applies solely to information collected by ODeskWork.com.

Security

ODeskWork.com takes industry standard protocols and technology to protect registered user information.

ODeskWork.com also protects registered user information offline. All registered user information is restricted within our offices. Servers used to store personally identifiable information are housed in a secure, supervised environment. In addition, only ODeskWork.com employees who need specific information to perform a task are granted access to personally identifiable information.

Communications

ODeskWork.com sends all newly registered users a welcome email to verify their email addresses. At times, ODeskWork.com sends service announcements to its registered Employers and Freelancers. Registered Users cannot unsubscribe from service announcements that discuss upcoming changes that affect their ODeskWork.com accounts. In addition, we communicate with registered members via personal emails or phone calls to provide requested services.

Optional Communications

Registered users receive monthly e-newsletters containing information on ODeskWork.com products, services and announcements. Occasionally, registered users receive e-postcards that highlight special ODeskWork.com announcements and features. Registered users can opt-out of the above listed communications. Please see our Choice/Opt-out section below.

Choice/Opt-out

Upon registration, users can opt-out of ODeskWork.com’s optional communications. Additionally, registered users can, at any time, modify their ODeskWork.com email (service announcement) preferences by updating their account information.

Notification of Changes

ODeskWork.com reserves the right to modify this privacy policy at any time, so please review it frequently. If ODeskWork.com alters its Privacy Policy, it will promptly post all changes in the Employer and Freelancer Announcement areas. By continuing to use ODeskWork.com after changes have been made to this policy, you are consenting to the changes.

1. INFORMATION COLLECTION

Users of the Service may be Clients (anyone utilizing the ODeskWork platform to request services to be performed by a Freelancer) or Freelancers (any company, individual user, or groups of associated individual users or companies utilizing the ODeskWork platform to offer services to Clients). Freelancers may also operate as an Agency (a legally recognized entity with the ability to hire and/or contract) with other Freelancers.

Information You Provide to Us

  • Personal Information: In the course of using the Service (whether as a Client or Freelancer), we may require or otherwise collect information that identifies you as a specific individual and can be used to contact or identify you (“Personal Information”). Examples of Personal Information include your name, email address, company address, billing address, and phone number.
  • Payment Information: If you use the Service to make or receive payments, we will also collect certain payment information, such as PayPal or other financial account information, and billing address.
  • Identity Verification: We may collect Personal Information, such as your date of birth or taxpayer identification number, to validate your identity or as may be required by law, such as to complete tax filings. We may request documents to verify this information, such as a copy of your government-issued identification or photo or a billing statement.
  • General Audience Service: The Service is general audience and intended for users 18 and older. We do not knowingly collect Personal Information from anyone younger than age 18. If we become aware that a child younger than 18 has provided us with Personal Information, we will use commercially reasonable efforts to delete such information from our files. If you are the parent or legal guardian of a child younger than age 18 and believe that ODeskWork has collected Personal Information from your child, please contact us at: legal@oDeskWork.com.
  • Non-Identifying Information/Usernames: We also may collect other information, such as zip codes, demographic data, information regarding your use of the Service, and general project-related data (“Non-Identifying Information”). We may aggregate information collected from ODeskWork registered and non-registered users (“ODeskWork Users”). We consider usernames to be Non-Identifying Information. Usernames are made public through the Service and are viewable by other ODeskWork Users.

2. INFORMATION USE
We use information collected through the Service to provide and improve the Service, process your requests, prevent fraud, provide you with information and advertising that may interest you, comply with the law, and as otherwise permitted with your consent.

Information that you specifically give us

While you use our products and services you may be asked to provide certain types of personal information. This might happen through our website, applications, online chat systems, telephone, paper forms, or in-person meetings. We will give you a Collection Notice at the time, to explain how we will use the personal information we are asking for. The notice may be written or verbal.

We may request, collect, or process the following information:

  • Account Details – username, password, profile picture.
  • Contact Details – email address, phone number.
  • Location Details – physical address, billing address, timezone.
  • Identity Details – full name, proof of identity (e.g. drivers licence, passport), proof of address (e.g. utility bill), photograph of the user.
  • Financial Information – credit card details, wire transfer details, payment processor details (e.g. skrill, paypal), tax numbers.
  • User Generated Content – project descriptions and attachments, bid description, user profiles, user reviews, contest descriptions and attachment, user messages etc.

Information that we collect from others

Users can give permission for us to connect to their account on other platforms to collect personal information. This includes but is not limited to Facebook, LinkedIn, and Google. Information collected will be governed by this Privacy Policy. Users can stop us from collecting data from other platforms by removing our access on the other platform or by contacting our support team.

Users have the ability to invite non-users to our platform by providing contact details such as email address. In these situations, the information will be collected and stored by us to contact the non-user and to prevent abuse of the invite systems.Your payment provider may transmit information about the payment that we may collect or process.

We may collect or process the following information:

  • Basic Details – username, profile picture.
  • Contact Details – email address, phone number.
  • Location Details – Physical Address, billing address, timezone.
  • Financial Information – payment account details (e.g. paypal email address and physical address), and wire transfer details.
  • List of contacts – email provider address book.
  • User Generated Content – user profile.

Information we collect as you use our service: We maintain records of the interactions we have with our users, including the products, services and customer support we have provided. This includes the interactions our users have with our platform such as when a user has viewed a page or clicked a button.When we are contacted we may collect personal information that is intrinsic to the communication. For example, if we are contacted via email, we will collect the email address used.

Site Visitors:
When you interact with Odeskwork through the Site or the Services (whether as a Freelancer, as a Client, a blog reader, software end user, external domain visitor, or other visitor to our Site), we and our service providers acting on our behalf will automatically collect information about you through cookies (small text files placed on your device) and other technologies. Please see our Cookie Policy to learn more about how we use cookies and other technologies.

As a visitor to our Site, our servers record information (“log data”), including information that your browser automatically sends whenever you visit the Site. This log data includes your Internet Protocol (“IP”) address (from which we understand the country you are connecting from at the time you visit the Site), browser type and settings, the date and time of your request. Where the information that we collect automatically on our Site is Personal Data, our legal basis for the use of this information is that it is necessary for the purposes of our legitimate interests in maintaining the safe operation of our Site as well as in learning how Site visitors interact with our Site to improve your use of it.

California Residents:
i. Scope
This section of the policy applies solely to California residents, in accordance with the California Consumer Privacy Act of 2018 (“CCPA”). As with other provisions of the Privacy Policy, this section details what Personal Data odeskwork collects, and how and why we collect this data. It’s important to note that odeskwork will never sell your data (as such term is defined in the CCPA), however, we may share your data through the course of business. Please see the section above titled, INFORMATION SHARING AND DISCLOSURE

Odeskwork collects Personal Data (from you) as part of the Freelancer Registration process, as well as the process for Clients. We collect information such as the following:

As stated in the sections above, our support services may request additional information. The data you provide is housed in internal databases for use during the registration and project/job selection process. A detailed explanation of the types of data we collect and its sources can be found under the above sections Information that you specifically give us, Information that we collect from others. Odeskwork also collects technical information through the use of cookies. For more information, please see the Cookie Policy, and the section above titled, information collection.

b. Your rights
CCPA affords you certain rights with regard to data collection and deletion. As of January 1, 2020, the CCPA gives you the following rights:
Right of access. Ask us what categories and types of data we have collected for you over the last 12 months, why the data was collected, and request a copy of such data.
Right of deletion. Request deletion of the data we have for you.
Right to not be discriminated against. You cannot be discriminated against for making a data inquiry.
To contact us, please see the section titled, Contacting Us. California residents are allowed two inquiries during a 12-month period. We will respond to your inquiry no later than 45 days after receipt.

c. Denial of data deletion requests

EU Individuals:
i. Scope
This section applies solely to individuals in the EU (for these purposes, reference to the EU also includes the European Economic Area countries of Iceland, Liechtenstein and Norway and, where applicable, Switzerland). Our Privacy Policy describes why and how Odeskwork collects, uses and stores your Personal Data, the lawful basis on which your Personal Data is processed, and what your rights and our obligations are in relation to such processing (please see “Your Rights” section below).

a. Data Controller
Odeskwork is the data controller for processing your Personal Data. The data controller is responsible for deciding how Personal Data about you is used. Please see the “Contacting Us” section below to find out how to contact us.

b. Your Rights
Subject to applicable EU law, you have the following rights in relation to your Personal Data:
Right of access. If you ask us, we will confirm whether we are processing your Personal Data and, if so, provide you with a copy of that Personal Data along with certain other details. If you require additional copies, we may need to charge a reasonable fee.
Right to rectification. If your Personal Data is inaccurate or incomplete, you are entitled to ask that we correct or complete it. If we shared your Personal Data with others, we will tell them about the correction where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so you can contact them directly.
Right to erasure. You may ask us to delete or remove your Personal Data. If we shared your data with others, we will tell them about the erasure where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data with so you can contact them directly.
Right to restrict processing. You may ask us to restrict or ‘block’ the processing of your Personal Data in certain circumstances, such as where you contest the accuracy of the data or object to us processing it. We will tell you before we lift any restriction on processing. If we shared your Personal Data with others, we will tell them about the restriction where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so you can contact them directly.
Right to data portability. You have the right to obtain your Personal Data from us that you consented to give us or that was provided to us as necessary in connection with our contract with you. We will give you your Personal Data in a structured, commonly used and machine-readable format. You may reuse it elsewhere.
Right to object. You may ask us at any time to stop processing your Personal Data, and we will do so: (1) If we are relying on a legitimate interest to process your Personal Data – unless we demonstrate compelling legitimate grounds for the processing or (2) If we are processing your Personal Data for direct marketing.
Rights in relation to automated decision-making and profiling. You have the right to be free from decisions based solely on automated processing of your Personal Data, including profiling, which produce a significant legal effect on you, unless such profiling is necessary for entering into, or the performance of, a contract between you and us, or with your explicit consent. We are not currently processing your Personal Data for such type of automated decision-making, including profiling, but if we elect to do so in the future we will provide you with notice and choice, in accordance with EU data protection law.
Right to withdraw consent. If we rely on your consent to process your Personal Data, you have the right to withdraw that consent at any time, but this will not affect any processing of your data that has already taken place.
You may exercise your rights by contacting us as indicated under “Contacting Us” section below.

c. Legitimate Interest
“Legitimate interests” means our interests in conducting and managing our organization and delivering the best Services to you. This Privacy Policy describes when we process your Personal Data for our legitimate interests, what these interests are and your rights. We will not use your Personal Data for activities where the impact on you overrides our interests, unless we have your consent or those activities are otherwise required or permitted by law. You have the right to object to processing that is based on our legitimate interests.

Data Transfers: oDeskwork is based in the India. When you apply as a Freelancer or use our services as a Client, or otherwise use our Site, your Personal Data will be transmitted to servers, as necessary to provide you with the services that you requested, administer our contract with you or to respond to your requests as described in this Privacy Policy, and the data may be transmitted to our service providers supporting our business operations (described above). India may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located. Where we transfer your Personal Data out of the European Economic Area (EEA) we will take steps to ensure that your Personal Data receives an adequate level of protection where it is processed and your rights continue to be protected.
You may exercise your opt-out right by notifying us if you wish to object to the use of your personal data for direct marketing purposes. Please send requests for such objections, access to data, correction of data, information regarding policies and practices and kinds of data held, questions or complaints to our Support Team.

d. Data Retention
Our policy is to keep your Personal Data only for as long as is reasonably necessary to fulfill the purposes for which it was collected and processed, including for the purposes of satisfying any legal, regulatory, accounting or reporting requirements. If you have elected to receive marketing communications from us, we retain information about your marketing preferences until you opt out of receiving these communications and in accordance with our policies.
To determine the appropriate retention period for your Personal Data, we will consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we use your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances we may anonymize your Personal Data so that it can no longer be associated with you, in which case it is no longer Personal Data.

 

 

WE USE INFORMATION WE COLLECT:

The information we request, collect, and process is primarily used to provide users with the product or service they have requested. More specifically, we may use your personal information for the following purposes:

to provide the service or product you have requested;
to provide technical or other support to you;
to answer enquiries about our services, or to respond to a complaint;
to promote our other programs, products or services which may be of interest to you (unless you have opted out from such communications);
to allow for debugging, testing and otherwise operate our platforms;
to conduct data analysis, research and otherwise build and improve our platforms;
to comply with legal and regulatory obligations;
if otherwise permitted or required by law; or
for other purposes with your consent, unless you withdraw your consent for these purposes.

To provide and improve the Service, complete your transactions, and address your inquiries, process your registration, verify the information you provide is valid and for compliance and internal business purposes;
To contact you with administrative communications and odeskwork newsletters, marketing or promotional materials (on behalf of odeskwork or third parties) and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please follow the instructions in the Your Account & Notification Settings section, below;
To tailor content we display to you and offers we may present to you, both on the Service and elsewhere online;
To administer and develop our business relationship with you and, if applicable, the corporation or other legal entity you represent;
To assess your proposal to perform a freelance project for odeskwork and prepare related governmental and internal statistics reports;
To enforce and comply with the law, including to conduct an investigation, to protect the property and rights of odeskwork or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, fraudulent, unethical or legally actionable activity. We may also use Device Identifiers to identify odeskwork Users; and
For the purposes disclosed at the time you provide your information, with your consent, and as further described in this Privacy Policy.
UNLESS YOU REQUEST THAT WE DELETE CERTAIN INFORMATION, WE RETAIN THE INFORMATION WE COLLECT FOR AT LEAST 5 YEARS AND MAY RETAIN THE INFORMATION FOR AS LONG AS NEEDED FOR OUR BUSINESS AND LEGAL PURPOSES.

3. INFORMATION SHARING AND DISCLOSURE
odeskwork will not sell or rent any collected information to third parties. odeskwork will not share your information with other users or third parties except in cases required to provide services you request through odeskwork.
We share your information with third parties, including service providers, regulated institutions (e.g., financial institutions), affiliated entities, and business partners as set out below. In the section below, we also list the reasons why we share information.

Information about Freelancers Shared with Clients: We share information regarding Freelancers working on a Client project, including information in workstream and work history, with Clients. Note that if a Freelancer is suspended from the odeskwork Service, we may share that information with Clients for whom that Freelancer has worked or applied for work. If you choose to apply for work as a Freelancer via the Service, we will share information relevant to your application with the applicable Client(s), including, but not limited to, the information contained in your Freelancer Profile.
Information about Clients Shared with Freelancers: If you have entered into a service contract with another user, we may provide him/her with your name, company address, billing address, or tax ID or VAT number in order to complete the transaction or to facilitate the resolution of a claim or dispute. The user receiving your information is not allowed to use it for purposes unrelated to the transaction, such as to contact you for marketing purposes, unless you have expressly consented to it.
Service Providers: We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services (e.g., without limitation, maintenance services, database management, web analytics and online advertising, payment processing, fraud detection and improvement of odeskwork’s features) or to assist us in analyzing how our Service is used. These third parties may have access to your Personal Information in order to perform these tasks on our behalf.
Legal and Investigative Purposes: odeskwork will share information with government agencies as required by law, including without limitation, in connection with reporting earnings. We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), at the request of governmental authorities or other third parties conducting an investigation, to protect the property and rights of odeskwork or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, fraudulent, unethical or legally actionable activity.
4. THIRD PARTY ANALYTICS PROVIDERS, AD SERVERS AND SIMILAR THIRD PARTIES

The personal information of users may be held, transmitted to or processed on our behalf outside India, including ‘in the cloud’, by our third party service providers. Our third party service providers are bound by contract to only use your personal information on our behalf, under our instructions.

Our third party service providers include:

  • Cloud hosting, storage, networking and related providers
  • SMS providers
  • Payment and banking providers
  • Marketing and analytics providers
  • Security providers
Third party applications:

Through the oDeskwork API it is possible for users to grant third party applications access to their Freelancer account. Depending on the permissions that are granted, these applications may be able to access some personal information or do actions on the users’ behalf. These third party applications are not controlled by us and will be governed by their own privacy policy. Users are able to remove third party applications from access their data through their settings. odeskwork works with (or may in the future work with) network advertisers, ad agencies, analytics service providers and other vendors to provide us with information regarding traffic on the Service, including pages viewed and the actions taken when visiting the Service; to serve our advertisements on other web sites, within mobile apps and elsewhere online; and to provide us with information regarding the use of the Service and the effectiveness of our advertisements. Our service providers may collect certain information about your visits to and activity on the Service as well as other websites or services, they may set and access their own tracking technologies on your device (including cookies and web beacons), and may use that information to show you targeted advertisements. Some of these parties may collect Personal Information when you visit the Service or other online websites and services. We may also share certain Non-Identifying Information with these parties, including Hashed Information, in connection with the services they provide to us.

5. YOUR CHOICES

You can use the Site without providing any Personal Data. If you choose not to provide any Personal Data, you may not be able to use certain services.

6. YOUR ACCOUNT & NOTIFICATION SETTINGS
Registered odeskwork Users may update their choices regarding the types of communications you receive from us through your online account. You also may opt-out of receiving marketing emails from us by following the opt-out instructions provided in those emails. Please note that we reserve the right to send you certain communications relating to your account or use of the Service (for example, administrative and service announcements) via email and other means and these transactional account messages may be unaffected if you opt-out from receiving marketing communications.

To STOP PUSH NOTIFICATIONS: You will need to send email to customer support at support@odeskwork.com

7. SECURITY
odeskwork takes commercially reasonable steps to help protect and secure the information it collects and stores about odeskwork Users. All access to the Site is encrypted using industry-standard transport layer security technology (TLS). When you enter sensitive information (such as tax identification number), we encrypt the transmission of that information using secure socket layer technology (SSL). We also use HTTP strict transport security to add an additional layer of protection for our odeskwork Users. But remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. Thus, while we strive to protect your personal data, odeskwork cannot ensure and does not warrant the security of any information you transmit to us.

8. CHANGING YOUR INFORMATION OR CLOSING YOUR ACCOUNT
Upon request odeskwork will provide you with information about whether we hold any of your personal information. You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information. You may access, correct, or request deletion of your personal information by making updates to that information or by contacting odeskwork through your online account. If you request to access all personal information you’ve submitted, we will respond to your request to access within 30 days. If you completely delete all such information, then your account may become deactivated. If your account is deactivated or you ask to close your account, you will no longer be able to use the Service. If you would like us to delete your account in our system, you can do so by sending an written request by email to support@odeskwork.com. We will use commercially reasonable efforts to honor your request; however, certain information will actively persist on the Service even if you close your account, including information in your Workstream and messages you posted to the Service. In addition, your Personal Information may remain in our archives and information you update or delete, or information within a closed account, may persist internally or for our administrative purposes. It is not always possible to completely remove or delete information from our databases. In addition, we typically will not remove information you posted publicly through or on the Service. Bear in mind that neither you nor odeskwork can delete all copies of information that has been previously shared with others on the Service.

9. USE OF PERSONAL INFORMATION
Odeskwork Reserve the Right to use its Users Account information to maintain their account. The profile you create on our Site will be publicly accessible unless otherwise indicated.

10. LINKS TO OTHER SITES

On our website, you will encounter links to third party websites. These links may be from us, or they may appear as content generated by other users. These linked sites are not under our control and thus we are not responsible for their actions. Before providing your personal information via any other website, we advise you to examine the terms and conditions of using that website and its privacy policy.
